I am not sure, but it looks like a Ficus, a not too happy one at that. Are you watering correctly? Check every day and water when needed that is when the surface is dry. What counrty are you in and where do you keep it?

I am in Southern California. I was keeping it in my room with, however just began keeping it on the patio due to that fact it wasn't looking to good. Figured it may be needing more sunlight??

Yes, possibly but watering is critical. Don't allow it to dry out, check every day with a chopstick, if it comes out clean then water.

It does not look like a ficus, but looks like a "tree of a thousand stars"

Update:
The tree is looking much better since my initial post, showing new growth near the base/roots. I have been putting it out in the sunlight during the day and bringing it in at night. I also starting using green dream organic fertilizer pellets. I just started to notice some white fuzzy mold/fungus. I did read that this tree is commonly found to have aphids and what not. Any suggestions for the mold and the small mites that may populate the soil? insecticides? Thanks!

Just brush the mould off. It is caused by dampness and will do no harm. As for "mites" if there are none then there is no problem. Aphids can be controlled with a very weak mix of soapy water. that is 1 drop in 2 litres of water.
